XOXONA Terms of Service

Operator: XOXONA.AI (“XOXONA”, “we”, “our”, or “us”)

These Terms of Service (“Terms”) govern your access to and use of the XOXONA platform, including our website, mobile applications, AI characters, creator tools, virtual currency systems, subscriptions, and related services (collectively, the “Services”).

By accessing or using XOXONA, you agree to these Terms. If you do not agree, you must not use the Services.

1. Eligibility, User Types, and Age Requirements

XOXONA provides services to two categories of platform participants:

(A) Users

“Users” are visitors, viewers, or consumers of content available on the platform.

Users may access XOXONA regardless of age, subject to applicable law. However:

• Users under the age of 18 may be restricted from accessing certain categories of content.
• XOXONA may use age-gating systems, content filtering, moderation systems, and other safety measures to provide age-appropriate experiences.
• For users under 18, XOXONA may limit or filter:
  • violent content,
  • sexual content,
  • sexually suggestive content,
  • inappropriate romantic interactions,
  • emotionally intense experiences,
  • or other content deemed unsuitable for minors.

(B) Creators

“Creators” are users who create, upload, publish, or distribute characters, prompts, media, conversations, roleplay experiences, or other content through the platform.

Creators may participate regardless of age, subject to applicable law. However:

• Creators under the age of 18 will be subject to additional safety restrictions and content limitations.
• XOXONA may restrict or prevent underage creators from creating:
  • sexual content,
  • graphic violence,
  • mature roleplay,
  • or other content considered inappropriate for minors.

Creators may receive compensation in the form of:

• virtual currency,
• digital rewards,
• engagement rewards,
• or other platform-based incentives.

However, cash payouts may only be made to:

• Creators who are at least 20 years old; or
• Creators who have obtained explicit parental or legal guardian consent.

XOXONA may require:

• proof of age,
• identity verification,
• parental consent documentation,
• or additional financial compliance documents

before approving any payout request.

XOXONA reserves the right to:

• suspend payouts,
• deny payouts,
• limit monetization access,
• or suspend accounts

where age verification information is inaccurate, incomplete, misleading, or in violation of platform policies.

2. Description of Services

XOXONA provides AI-powered services including:

• fictional AI characters,
• conversational AI systems,
• roleplay experiences,
• creator-generated characters,
• recommendation systems,
• personalization systems,
• creator monetization tools,
• virtual items or currency,
• and subscription-based features.

Certain interactions, characters, and outputs may be dynamically generated using machine learning systems and automated technologies.

3. Account Registration and Security

Users may be required to create an account to access certain Services.

Users are responsible for:

• maintaining account security,
• protecting login credentials,
• all activity under their accounts,
• and keeping account information accurate.

Users may not:

• share accounts,
• sell accounts,
• transfer accounts,
• or use automated methods to create accounts.

XOXONA may restrict or terminate accounts involved in:

• fraud,
• abuse,
• impersonation,
• platform manipulation,
• or prohibited activity.

4. User Content and Creator Content

Users and Creators retain ownership of their original intellectual property rights and copyrights in the content they create, to the extent permitted by applicable law.

However, by uploading, publishing, submitting, or making content available on XOXONA, Users and Creators grant XOXONA a:

• worldwide,
• non-exclusive,
• royalty-free,
• sublicensable,
• transferable,
• irrevocable,
• perpetual

license to:

• use,
• host,
• reproduce,
• distribute,
• display,
• modify,
• adapt,
• translate,
• promote,
• advertise,
• market,
• publicly communicate,
• improve platform systems,
• train recommendation or AI systems,
• and otherwise commercially exploit such content.

This license applies across all forms of media and distribution channels, whether online, offline, existing now, or developed in the future.

The foregoing rights include the right to use:

• creator names,
• character names,
• avatars,
• thumbnails,
• screenshots,
• previews,
• clips,
• prompts,
• metadata,
• and public-facing content

for purposes including:

• social media promotion,
• advertising campaigns,
• app store promotion,
• influencer marketing,
• investor presentations,
• public relations activities,
• creator discovery,
• platform showcases,
• recommendation systems,
• and other commercial or promotional purposes.

No additional compensation, approval, or notice shall be required for such uses.

Creators represent and warrant that they possess all necessary rights to upload and license such content to XOXONA.

5. AI-Generated and Fictional Content

XOXONA provides AI-generated conversations, fictional characters, recommendations, roleplay experiences, and synthetic outputs generated through machine learning systems.

Users acknowledge that AI-generated content may:

• be inaccurate,
• fictional,
• incomplete,
• misleading,
• emotionally persuasive,
• inconsistent,
• offensive,
• contextually inappropriate,
• or factually incorrect.

AI-generated content does not constitute:

• verified facts,
• professional advice,
• emotional authenticity,
• or official statements by XOXONA.

Users are solely responsible for evaluating and verifying AI-generated content before relying on it.

Users further acknowledge that:

• AI characters are not real people,
• AI relationships are simulated,
• AI affection and attachment behaviors are algorithmically generated,
• and conversations may be dynamically generated without human review.

XOXONA does not guarantee:

• factual accuracy,
• uniqueness,
• emotional realism,
• uninterrupted continuity,
• or permanent availability of AI-generated content.

6. Emotional Dependency and AI Relationship Risks

XOXONA is designed for entertainment, creativity, fictional interaction, and roleplay experiences.

Users should not:

• become emotionally dependent on AI characters,
• treat AI interactions as substitutes for real human relationships,
• rely on AI systems for emotional validation,
• or isolate themselves from real-world support systems.

AI systems may simulate:

• affection,
• intimacy,
• empathy,
• attachment,
• romantic behavior,
• memory,
• or companionship,

but such behaviors are computational outputs rather than genuine human emotional experiences.

Some features may simulate:

• memory,
• continuity,
• relationship progression,
• familiarity,
• or personalized recall.

Users acknowledge that:

• AI memory systems may be incomplete or inaccurate,
• remembered details may be incorrect,
• continuity may reset unexpectedly,
• character behavior may vary,
• and conversations may not persist permanently.

7. No Professional Advice

XOXONA is not a provider of:

• medical advice,
• therapy,
• psychiatric services,
• mental health counseling,
• legal advice,
• financial advice,
• emergency services,
• or crisis intervention.

Content generated through XOXONA should not be relied upon as a substitute for licensed professionals.

If you are experiencing:

• suicidal thoughts,
• emotional distress,
• abuse,
• mental health emergencies,
• medical emergencies,
• or immediate danger,

please contact qualified professionals or emergency services immediately.

8. Prohibited Conduct

Users may not use XOXONA to:

• violate laws,
• exploit minors,
• create prohibited sexual content,
• impersonate real individuals,
• infringe intellectual property rights,
• scam or defraud users,
• distribute malware,
• harass others,
• engage in hate speech,
• manipulate the platform,
• bypass moderation systems,
• scrape or reverse engineer Services,
• artificially inflate monetization,
• or otherwise violate platform policies.

Users may not upload or create content involving:

• unauthorized celebrity likenesses,
• deceptive deepfakes,
• copyrighted fictional characters without authorization,
• anime clones that infringe protected works,
• or infringing derivative content.

Users must comply with:

• Community Guidelines,
• Minor Protection Policy,
• Content Policies,
• and all related safety rules.

Illegal and Restricted Content (Thailand)

Users may not use XOXONA to create, upload, distribute, request, promote, generate, or transmit content that violates applicable laws, regulations, or governmental requirements.

Prohibited content and conduct include, but are not limited to:

• content that defames, insults, threatens, or expresses malice toward the King, Queen, Heir-apparent, or Regent of Thailand;
• content that may violate Section 112 of the Thai Criminal Code;
• false, misleading, deceptive, or fraudulent information that may violate the Computer Crime Act B.E. 2550 (2007) and its amendments;
• misinformation or fabricated content likely to cause public harm, panic, confusion, or unlawful damage;
• content threatening national security, public safety, or public order;
• unlawful impersonation or deceptive identity simulation;
• unlawful deepfakes or manipulated media;
• content facilitating criminal activity;
• or any content otherwise prohibited under applicable law.

Users are solely responsible for ensuring that their content and conduct comply with all applicable laws in their jurisdiction.

XOXONA reserves the right to remove, restrict, preserve, monitor, report, or disclose relevant content or account information where reasonably necessary for:

• legal compliance,
• regulatory requests,
• law enforcement cooperation,
• platform safety,
• or operational integrity.

9. Mature and Restricted Content

Certain features or content may contain:

• mature themes,
• fictional romance,
• emotionally intense interactions,
• suggestive content,
• or age-restricted creator experiences.

Users may only access such features where legally permitted.

XOXONA may:

• age-gate content,
• restrict visibility,
• require verification,
• or remove mature content at its discretion.

10. Creator Monetization

Eligible Creators may participate in XOXONA monetization programs subject to platform rules and additional requirements.

Creators may receive:

• virtual currency,
• engagement rewards,
• subscription revenue sharing,
• digital incentives,
• or other platform-based benefits.

Creators under the age of 20:

• may receive virtual rewards within the platform;
• but may not receive cash payouts unless parental or legal guardian consent has been verified by XOXONA.

XOXONA may impose additional requirements including:

• payout thresholds,
• KYC verification,
• tax documentation,
• banking verification,
• parental consent verification,
• and regulatory compliance procedures

before processing payouts.

11. Virtual Currency and Payments

XOXONA may provide:

• virtual currency,
• digital points,
• tokens,
• subscriptions,
• or digital items.

Unless otherwise required by law:

• virtual items have no cash value,
• are non-transferable,
• non-refundable once consumed,
• and may not be redeemed outside the platform.

Paid features may automatically renew until canceled.

Users are responsible for:

• taxes,
• payment accuracy,
• applicable fees,
• and exchange rate differences.

Refund eligibility may depend on:

• applicable law,
• platform provider rules,
• usage status,
• and separate refund policies.

12. Intellectual Property and Copyright

XOXONA and its Services, including:

• software,
• branding,
• interfaces,
• recommendation systems,
• moderation systems,
• platform design,
• and related materials

are owned or licensed by XOXONA and protected by applicable laws.

Users may not:

• copy,
• reverse engineer,
• redistribute,
• exploit,
• or commercially use platform assets without authorization.

Users are responsible for ensuring they have appropriate rights for uploaded content.

XOXONA does not guarantee that user-generated or AI-generated content is free from infringement claims.

Users who believe content infringes their intellectual property rights may contact through Discord

XOXONA may:

• remove content,
• restrict visibility,
• suspend creators,
• withhold monetization,
• or terminate repeat infringers.

13. Moderation and Enforcement

XOXONA may use:

• automated moderation systems,
• AI safety classifiers,
• human moderators,
• filtering systems,
• behavioral analysis,
• and abuse detection technologies

to enforce policies and maintain platform safety.

Users acknowledge that:

• moderation systems are imperfect,
• harmful content may occasionally appear,
• AI systems may generate unexpected outputs,
• some content may be incorrectly restricted or removed,
• and moderation decisions may involve subjective judgment.

Enforcement actions may include:

• warnings,
• content removal,
• visibility reduction,
• demonetization,
• suspension,
• permanent bans,
• payout restrictions,
• or feature limitations.

Immediate Enforcement Actions

XOXONA may immediately remove content, restrict visibility, suspend accounts, demonetize creators, limit platform functionality, disable features, or terminate access without prior notice where reasonably necessary to address:

• illegal content,
• child exploitation risks,
• non-consensual sexual content,
• deepfake abuse,
• impersonation,
• scams or fraud,
• intellectual property infringement,
• violent threats,
• harassment,
• hate speech,
• misinformation,
• coordinated manipulation,
• platform abuse,
• security threats,
• app store compliance risks,
• payment processor compliance risks,
• legal or regulatory risks,
• or conduct that may expose XOXONA, users, creators, advertisers, partners, or third parties to legal, reputational, operational, or safety risks.

XOXONA reserves sole discretion in determining whether content, conduct, or account activity violates platform policies or creates unacceptable platform risk.

Enforcement actions may occur automatically through moderation systems, manually through human review, or pursuant to legal or regulatory requests.

14. Privacy and Data Use

Use of XOXONA is also governed by:

• the Privacy Policy,
• Cookie Policy,
• and related privacy notices.

Users acknowledge that AI interactions, analytics systems, personalization systems, and moderation systems may process user data as described in those policies.

Doxxing Reports and Verification

XOXONA may investigate reports involving the unauthorized disclosure of personal information.

To evaluate such reports, XOXONA may review:

• reported content;
• relevant account information;
• limited conversation records;
• screenshots or supporting evidence submitted by the reporting party;
• and other information reasonably necessary to assess the report.

XOXONA is not required to independently verify the accuracy of all reported personal information and may remove or restrict content where there is a reasonable belief that the content discloses, threatens to disclose, or facilitates access to personal information of a real person.

15. Third-Party Services

XOXONA may integrate with third-party providers including:

• AI model vendors,
• app stores,
• payment processors,
• cloud providers,
• analytics vendors,
• authentication providers,
• moderation vendors,
• and customer support tools.

XOXONA is not responsible for:

• third-party outages,
• external platform policies,
• payment failures outside our systems,
• third-party security incidents,
• or third-party actions outside our reasonable control.

Third-party services may be governed by separate terms and privacy policies.

16. Disclaimer of Warranties

The Services are provided on an “AS IS” and “AS AVAILABLE” basis.

To the maximum extent permitted by law, XOXONA disclaims warranties including:

• merchantability,
• fitness for a particular purpose,
• non-infringement,
• uninterrupted availability,
• security,
• reliability,
• or accuracy.

XOXONA does not guarantee:

• error-free AI outputs,
• emotional suitability,
• uninterrupted service,
• permanent memory persistence,
• permanent character availability,
• uninterrupted subscriptions,
• uninterrupted monetization,
• or compatibility with all devices.

Features, pricing, AI systems, moderation systems, creator tools, and characters may change, be suspended, or be discontinued at any time.

17. Limitation of Liability

To the maximum extent permitted by law, XOXONA and its affiliates, officers, employees, contractors, licensors, partners, and service providers shall not be liable for:

• indirect damages,
• emotional distress,
• psychological harm,
• reputational harm,
• lost profits,
• loss of data,
• business interruption,
• AI-generated outputs,
• user-generated content,
• creator misconduct,
• reliance on AI interactions,
• or service interruptions.

Some jurisdictions may not allow certain limitations of liability. In such cases, applicable legal protections may apply.

18. Indemnification

Users agree to indemnify and hold harmless XOXONA from claims arising from:

• User Content,
• misuse of the Services,
• policy violations,
• intellectual property disputes,
• illegal conduct,
• or violations of these Terms.

19. Suspension and Termination

XOXONA may suspend, restrict, or terminate access to the Services where reasonably necessary for:

• safety,
• legal compliance,
• fraud prevention,
• abuse prevention,
• moderation enforcement,
• or operational reasons.

Upon termination:

• licenses granted to users may end,
• monetization access may be revoked,
• virtual items may be forfeited where permitted,
• and access to content may be limited.

XOXONA may suspend, restrict, terminate, or permanently ban accounts without prior notice where reasonably necessary to:

• comply with applicable law,
• respond to regulatory obligations,
• address repeated policy violations,
• prevent platform abuse,
• mitigate safety risks,
• preserve platform integrity,
• maintain app store compliance,
• or reduce operational, legal, reputational, or commercial risk.

Repeated or severe violations involving illegal content, child safety risks, fraud, impersonation, deepfake abuse, intellectual property infringement, misinformation, or harmful conduct may result in permanent account termination.

20. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of Thailand.

To the extent permitted by law:

• disputes may be resolved through arbitration or courts designated by XOXONA,
• and users agree to attempt informal resolution before formal proceedings where reasonably possible.

Additional consumer rights may apply depending on jurisdiction.

21. Changes to These Terms

XOXONA may update these Terms periodically to reflect:

• legal developments,
• operational changes,
• new features,
• AI system updates,
• safety improvements,
• or business needs.

Updated Terms will be posted with a revised Effective Date.

Continued use of the Services after updates constitutes acceptance of the revised Terms.
